Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of NexWall, including the mobile app, the NexWall Developer Wallpaper API and developer portal, related APIs, and our public website, support and legal pages (the "Services"). The Services are provided by KodNex Technologies, a sole business based in India ("KodNex", "we", "our", or "us").

By using NexWall, you agree to these Terms. If you do not agree, please stop using the service.

1. Eligibility

  • You must use NexWall in compliance with applicable laws and platform policies.
  • You are responsible for your account activity and for keeping account credentials secure.
  • If local law requires parental consent for minors, such consent must be obtained before use.
  • You must be at least 18 years old to create an account (in the app or on the developer portal) or to buy a paid Developer API plan.

2. License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use NexWall for personal, non-commercial use.

Developer API integrations are governed by the separate NexWall Developer API License. That license permits qualifying commercial application integrations and controls if it conflicts with this section for Developer API use.

3. Content Usage Rules

  • Static, video and live wallpapers are provided for personal device customization unless stated otherwise.
  • You must respect copyrights, trademarks, and other intellectual property rights.
  • You must not claim ownership of content you did not create or license.
  • You must not remove attribution, watermark, or rights notices where they exist.
  • Commercial API integrations must comply with the Developer API License; other commercial use, redistribution, or resale requires permission from the applicable rights holder.
  • If you upload personal photos for the auto wallpaper changer, you must own them or have the right to use them. They are stored for your own use only.

4. Prohibited Activities

  • Reverse engineering, unauthorized scraping, bulk extraction, or API abuse.
  • Attempting unauthorized access to systems, accounts, endpoints, or admin interfaces.
  • Introducing malware, scripts, bots, or activity that degrades service reliability.
  • Using NexWall in any way that violates law, third-party rights, or app store rules.

5. Developer API Acceptable Use

If you use the NexWall Developer Wallpaper API, in addition to the Developer API License, you must not:

  • Resell raw content: sell, sublicense or redistribute raw wallpaper files, mirror the catalog, publish bulk download archives or datasets, or offer the API (or a copy of it) under your own brand.
  • Scrape or exceed your quota: scrape the API or website, bypass authentication or rate limits, rotate or create multiple accounts or keys to get around your plan's quota, or share API keys publicly.
  • Use it unlawfully: use the API or its content in any unlawful, deceptive, defamatory, infringing or harmful product, or in breach of app store or advertising-network policies.
  • Disrupt the service: send traffic intended to overload, test the security of, or interfere with our systems without our written permission.

We may throttle, suspend or revoke API keys used in breach of this section.

6. Paid Plans, Payments and Refunds

  • Paid Developer API plans are one-time prepaid terms (monthly or yearly) with no auto-renewal. When a term ends, your account returns to the Free plan (100 requests per day) unless you buy a new term.
  • Payments are made through Razorpay (India, INR) or by international bank transfer (USD). Plans are delivered digitally; nothing is shipped.
  • An invoice is emailed for every paid plan. KodNex Technologies is not registered under GST, so no GST is charged.
  • Refunds are handled under our Refund & Cancellation Policy.

7. Wallpaper Content, Third-Party Rights and Removals

  • Nature of the content. Wallpapers on NexWall include original artwork, AI-generated artwork and images from other sources. Some wallpapers may show genres, styles or themes that are popular in films, anime, games, sports or other media.
  • No affiliation. NexWall and KodNex Technologies are not affiliated with, sponsored by or endorsed by any film or animation studio, comic or book publisher, game company, sports league or club, vehicle or other brand, or any celebrity or public figure. Any third-party names, characters, logos and trademarks belong to their respective owners and are referred to for identification only.
  • No rights in third-party marks. Your use of NexWall does not give you any right in a third party's trademarks, characters, logos, or a real person's name or likeness. Do not use such elements from wallpapers to brand, advertise or sell your own products.
  • Removals. We may remove, replace, rename or restrict any wallpaper, category, tag or name at any time and without notice, including after a copyright, trademark, personality-rights or other complaint, a takedown notice, or a request from an app store, payment provider, hosting provider or authority.
  • No refund for removals. Content removals or restrictions, the loss of particular themes, styles or characters, and any suspension or limitation of the service made because of such a claim, notice or request do not entitle anyone to a refund, credit, compensation or plan extension, as set out in our Refund & Cancellation Policy.

8. Copyright and DMCA Policy

NexWall respects the intellectual property rights of others and responds to valid complaints.

If you are a copyright owner, or authorized to act for one, and believe that any content on NexWall (in the app, on the website, or delivered through the Developer API) infringes your copyright, please send a takedown notice to support@kodnextech.com with the following details:

  • A description of the copyrighted work that you claim has been infringed.
  • A screenshot or exact link to the infringing material within our app, website or API response (for example the wallpaper ID or URL).
  • Your contact information (name, address, telephone number, and email).
  • A statement that you have a good faith belief that the use of the material is not authorized.
  • A statement that the information in your notice is accurate and that you are the owner or authorized to act on the owner's behalf.
  • Your physical or electronic signature.

Upon receipt of a valid notice, we will promptly remove the infringing content. Where content is removed, Developer API users must also stop serving it, as set out in the Developer API License. We may close the accounts of users who repeatedly infringe.

9. Advertisements

NexWall displays third-party ads through Google AdMob. We do not control advertiser products or claims. Your interactions with advertisers are strictly between you and those third parties.

10. Intellectual Property

NexWall branding, source code, interface components, and service assets are owned by or licensed to KodNex. All rights not expressly granted remain reserved by the lawful owners.

11. Service Availability and Updates

  • We may add, change, pause, or remove features for maintenance, security, or product updates.
  • We may require minimum app versions for compatibility and safety.
  • Service interruptions may occur due to network, provider, or infrastructure events.

12. Disclaimer of Warranties

NexWall is provided on an "as is" and "as available" basis, without warranties of any kind, to the extent permitted by law.

13. Limitation of Liability

  • To the maximum extent permitted by law, KodNex Technologies is not liable for indirect, incidental, special, or consequential damages, or for loss of profits, revenue, data or goodwill, arising from use of, or inability to use, the Services.
  • Developer API: our total liability for all claims relating to the Developer API is limited to the fees you paid us for the Developer API in the 12 months before the event giving rise to the claim.
  • Free Services: the NexWall app, the Free API plan and the website are provided free of charge on an "as is" basis. To the extent permitted by law, we have no liability arising from your use of them.
  • Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Indemnification

You agree to defend and indemnify NexWall and its team from claims, losses, or expenses caused by your misuse of the service or violation of these Terms.

15. Termination

  • By you: you can stop using the Services at any time. You can delete your app account in the app, and request deletion of any account through our Data Deletion page.
  • By us: we may suspend or terminate access, including API keys, where necessary for policy enforcement, legal compliance, abuse prevention, security protection, or a breach of these Terms or the Developer API License.
  • Effect: when access ends, your right to use the Services ends and your API keys stop working. Refunds for paid plans, if any, follow the Refund & Cancellation Policy. Sections that by their nature should continue (such as intellectual property, limitation of liability, indemnification and governing law) survive termination.

16. Account and Security Responsibilities

  • You are responsible for maintaining confidentiality of your login credentials.
  • Any activity performed through your account is considered authorized by you unless reported as unauthorized access.
  • You must notify us quickly if you suspect account compromise or unauthorized activity.

17. Governing Law and Disputes

  • These Terms are governed by the laws of India.
  • If you have a dispute with us, please first email support@kodnextech.com with the details. We will both try in good faith to resolve it by email within 30 days.
  • If it is not resolved within 30 days, either party may take it to the courts of competent jurisdiction in India.
  • Where mandatory local consumer laws apply to you, those laws take precedence over conflicting clauses.

18. Privacy and Data

Your use of NexWall is also subject to our Privacy Policy, which explains data collection, usage, retention, and your rights.

19. Changes to Terms

We may revise these Terms. We will post the updated Terms on this page and change the "Last updated" date. For material changes, we will give reasonable advance notice in the app, on the developer portal, or by email before they take effect. Continued use after the changes take effect means you accept the revised Terms. If you do not agree, you must stop using the Services.
